Indian Patent Scenario
There is no special legislation in India governing ‘electronics and electrical inventions’. As per the scheme of patents law in India inventions are generally defined and protection is uniformly accorded to all patentable inventions irrespective of their nature (including electronic inventions). Of all electronic inventions, perhaps software or computer programs and patents thereof have been extensively debated the world over. The position in India has been quite similar.
Software plays a major role in almost all electronic devices and electronically-controlled devices. Software programs per se are excluded from the scope of patentable inventions in the India under Section 3(k) of the Indian Patents Act (a mathematical or business method or a computer programme per se or algorithms, are not patentable).
As computer programs with technical application to the industry or embedded in hardware are included within the scope of patentable protection, the parameters for patentability that the Patent Office look for in respect of software-related inventions have not been seen basically different from those applied in respect of non-software related inventions.
Cases Granted (software related inventions)

Goldenchart Co was granted patent No. 198592 in respect of an asset management advice system. Although the invention is basically a business method, presentation of it as an asset management advice system was acceptable to the Patent Office.

Siemens was granted patent No. 195440 in respect of a method for testing system components of an object-oriented program.

Philips Electronics was granted patent No. 194663 in respect of an interactive entertainment apparatus operable to output sequences of image frames. Although computer programs per se are not patentable in India, the above claim was allowed as it is directed to an interactive entertainment apparatus.
